A 21-year-old Uber Eats delivery driver was in superior court Monday after he allegedly raped the woman who waited for her order.

An Uber driver took advantage of a woman customer — forcing her to touch and perform a sexual act on him — on the side of the Dolphin Expressway late Sunday night, according to the Florida Highway Patrol.

Uber did not secure a writ of mandamus from the Ninth Circuit, which upheld the Judicial Panel on Multidistrict Litigation’s order consolidating riders’ sexual assault claims against Uber for the alleged behavior of drivers who work for the rideshare app.
